News Brief: Change Healthcare Cyberattack Causes Unprecedented Disruptions

On Feb. 21, 2024, Change Healthcare, a subsidiary of UnitedHealth Group (UHG) and one of the largest platforms for managing health insurance billing and payments in the United States, experienced a large-scale cyberattack. This attack forced the company to shut down over 100 services across its system for multiple weeks, affecting millions of health care providers and patients across the country.

Legal Update: Biden Budget Proposes National Paid Family and Medical Leave

President Joe Biden’s proposed budget for fiscal year 2025 includes a national paid family and medical leave program and urges Congressional action on mandatory paid sick leave.
Biden’s budget would establish a national paid family and medical leave program that would be administered by the Social Security Administration and provide workers with progressive, partial wage replacement to take time off for family and medical reasons.

Health Plan Eligibility: Do’s and Don’ts

Employers sponsoring group health plans have some flexibility when deciding which groups of employees and dependents will be eligible for coverage. However, there are several crucial eligibility requirements employers should adhere to for health coverage. These rules can be categorized into important eligibility “do’s” and “don’ts” for employers to follow.
A basic eligibility “do” is following the terms of the health plan’s written plan document, including its eligibility rules. Also, to avoid potential penalties, applicable large employers (ALEs) should ensure they offer affordable coverage to their full-time employees. Other important “do’s” include making coverage available for adult children up to age 26 and continuing to offer coverage for Medicare-eligible employees when the health plan is the primary payer.
Essential “don’ts” for health plan eligibility include offering coverage to nonemployees, such as independent contractors, andimposing waiting periods that exceed 90 days. Other crucial “don’ts” are overlooking applicable nondiscrimination requirements when establishing eligibility rules and excluding employees from coverage based on health status-related factors.

The U.S. Equal Employment Opportunity Commission (EEOC) is a federal agency responsible for enforcing federal equal employment opportunity (EEO) laws. Each EEO law listed below covers certain private-sector employers and prohibits retaliation and related conduct. Retaliation occurs when an employer penalizes an employee or applicant for asserting his or her right to be free from discrimination under the EEO laws, including:
- Title VII of the Civil Rights Act of 1964 (Title VII)
- The Equal Pay Act of 1963 (EPA)
- The Age Discrimination in Employment Act of 1967 (ADEA)
- Titles I and V of the Americans with Disabilities Act of 1990 (ADA)
- Title II of the Genetic Information Nondiscrimination Act of 2008 (GINA)
- The Pregnant Workers Fairness Act of 2022 (PWFA)

Legal Update: EEOC Releases Data Dashboard from 2017 and 2018 Pay Data Collec

On March 12, 2024, the U.S. Equal Employment Opportunity Commission (EEOC) made available aggregated data it received from employers and certain federal contractors regarding employee pay band by race, sex, ethnicity and job group during 2017 and 2018. This information is now available on a new interactive data dashboard called “EEOC Explore” that aims to promote pay equality by allowing industries, employers and individuals to assess how their pay by sexand race compares to others in their industry, job category or state.

HR Brief – USCIS Issues Final Rule to Adjust Certain Immigration and Naturalization Fees (March)

Recently, the U.S. Citizenship and Immigration Services (USCIS) released a final rule to increase immigration and naturalization fees for multiple employment-based petitions and applications, effective April 1, 2024.
Background
The USCIS last adjusted its fees in December 2016. The final rule’s fee increases will allow the USCIS to help offset overall costs.The USCIS plans to hire additional personnel to help manage the sizeable number of cases the agency receives.
